This website, www.fcipros.com (the “Site”), is operated by Food Concepts, Inc. (“Food Concepts,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms and Conditions. If you use the Site on behalf of an organization, you represent that you are authorized to do so.
Business accounts and authorized users
The Site is intended for business customers and their authorized representatives. Your organization is responsible for determining who may access its account, view customer-specific information, and place orders. Users are responsible for keeping their login credentials confidential. Please notify Food Concepts promptly if you suspect unauthorized access to your account.
Please keep your organization’s account, billing, shipping, and contact information current. We may verify account information or restrict access when reasonably necessary to protect an account, investigate suspected misuse, or maintain the security of the Site.
Customer-specific information
The Site may display products, pricing, documents, or other information specific to your organization. This information is provided for your organization’s business use. You may share it with employees and representatives who need it for that purpose. You may not publish it or share it with other organizations without Food Concepts’ permission, unless a separate agreement permits you to do so.
Access to one organization’s account does not authorize access to another organization’s information.
Product information
We work to present accurate product descriptions, images, specifications, availability, and pricing. Images may illustrate a product or configuration and may show accessories or other items that are not included. Please review the product description and any applicable quote or order documentation to confirm what is included.
If information appears incorrect or unclear, please contact us before ordering. We may correct errors on the Site. If a correction materially affects an order you have submitted, we will contact you to resolve the issue.
Orders and purchase orders
When you submit an order through the Site, it is sent directly to Food Concepts’ internal order system for processing. You are responsible for reviewing the items, quantities, shipping information, and any required purchase order number before submission.
The message “Your order has been received” confirms that your order reached our system. If we discover an issue with pricing, availability, product information, or fulfillment, we will contact you to resolve it. Please contact us as soon as possible if you need to correct or cancel an order; available changes depend on how far it has progressed through processing.
If your organization requires a purchase order or internal approval, you are responsible for obtaining that authorization before placing the order. Terms included on a purchase order do not change a separate written agreement with Food Concepts unless both parties agree to the change in writing.
Pricing, payment, and taxes
Customer-specific pricing may vary. The applicable price is the price confirmed for the transaction under your organization’s written agreement, accepted quote, or order documentation. Payment must be received prior to shipment of equipment, premiums, or merchandising materials, unless a separate written agreement with Food Concepts expressly provides different payment terms.
Unless otherwise stated for the transaction, displayed prices do not include shipping, handling, or applicable taxes. Charges will be identified through the applicable checkout, quote, invoice, or order process. If your organization claims a tax exemption, please provide valid exemption documentation before the transaction is processed. Whether an exemption applies depends on applicable law and the documentation provided.
Shipping and delivery
Shipping methods, charges, delivery arrangements, and any estimated dates are determined through the applicable checkout, quote, order, or customer agreement. Please review the information provided for your transaction and contact us promptly if a delivery requirement is missing or incorrect.
Terms for branded equipment and materials
These terms apply to branded equipment, premiums, and merchandising materials provided by Food Concepts, Inc. on behalf of its partner brands:
- Only qualifying foodservice operators are eligible to participate.
- Payment must be received prior to shipment of equipment, premiums, or merchandising materials, unless a separate written agreement with Food Concepts expressly provides different payment terms.
- Equipment will be used solely for the purpose of displaying products from the associated brand.
- Customer will not modify the equipment or remove any brand trademarks or logos.
- Equipment may not be relocated from the designated place of business without written consent from Food Concepts, Inc. or the brand owner.
- Customer is responsible for maintaining the branded equipment and restocking it with the associated brand’s products during the term of the applicable agreement.
- Customer will indemnify and hold the brand owner harmless from claims resulting from the installation, use, or removal of equipment, to the extent permitted by applicable law.
- Food Concepts, Inc. and its brand partners reserve the right to audit the customer for compliance with the applicable agreement.
- Customer will relinquish the equipment upon breach of these branded equipment terms, subject to the applicable agreement and law.
Other agreements
Your organization may have a separate written agreement with Food Concepts covering products, pricing, payment, fulfillment, confidentiality, branded equipment, or other matters. That agreement controls where it conflicts with these Terms and Conditions on a matter it covers. A quote or order may also contain transaction-specific details.
Privacy and order communications
Our Privacy Policy describes our practices concerning information collected through the Site. By completing a purchase, you agree to receive email communications from Food Concepts, Inc. regarding your order. Please keep your contact information up to date so we can reach you about its processing and fulfillment.
Acceptable use and Site content
You may use the Site for lawful business purposes related to Food Concepts’ products and services. You may not attempt unauthorized access, interfere with the Site’s security or operation, introduce malicious code, or collect Site information through automated means without our permission.
The Site’s text, images, graphics, logos, and other content are owned by Food Concepts or used with permission. You may use that content as reasonably needed for your organization to evaluate and purchase our products and services. Other copying, publication, or commercial use requires permission from the applicable rights holder.
Third-party websites and services
The Site may link to websites or use services operated by third parties. Those parties are responsible for their own websites, services, and policies. A link does not necessarily indicate Food Concepts’ endorsement.
Site availability and changes
We may update the Site and may occasionally need to limit or interrupt access. We do not guarantee uninterrupted availability. We may revise these Terms and Conditions by posting an updated version with a new effective date. Revised terms apply to future Site use; they do not automatically change an existing order or separate written agreement.
Governing law
These Terms and Conditions are governed by the laws of Wisconsin, except where applicable law requires otherwise. If any provision is found unenforceable, the remaining provisions remain in effect.
